1. Preamble

These Terms and Conditions of Sale (hereinafter "T&Cs") govern the contractual relationship between:

THC Labs, a Czech limited liability company (THC Labs S.R.O., IČO: 23335882), with its registered office at Kaprova 42/14, 110 00 Prague 1, Czech Republic, operating the website www.spacecake.co, hereinafter referred to as "the Seller" or "the Company";
And any adult individual or legal entity making a purchase on the website, hereinafter referred to as "the Customer" or "the Buyer".

These T&Cs apply to any order placed by a Customer residing in one of the following countries: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom.

These T&Cs are established in accordance with:

  • Directive 2011/83/EU on consumer rights,
  • Regulation (EU) 2016/679 (GDPR),
  • National legislation in force in the consumer's country of residence.
  • And, for British consumers, the UK Consumer Rights Act 2015 and UK GDPR.

2. Products

The products sold are described and presented with the greatest accuracy on the website. These are products based on hemp and CBD, in compliance with the legislation in force in the authorised delivery countries.

⚠️ All products offered comply with the maximum THC level authorised in the delivery country (below 0.2%). No therapeutic or medical products are offered. The Customer is responsible for verifying the legality of the purchase under their local legislation.

Strictly Non-Medical Use

The products sold are not intended to diagnose, treat, cure or prevent any disease. They are in no way medicines. The Customer acknowledges using the products under their sole responsibility, in accordance with the regulations in force in their country.

3. Orders

3.1 Order Process

The Customer selects products and validates their basket. Before payment, a summary allows them to check the details, total price including VAT, and any shipping costs.

3.2 Acceptance of T&Cs

Acceptance of the T&Cs is mandatory to complete any order. This is confirmed by ticking a box during payment.

Orders, invoices and communications are archived on a reliable and durable medium and may be produced as evidence.

4. Prices

Prices are shown in euros (€), inclusive of all taxes (VAT included where applicable). For deliveries outside the European Union (e.g. πŸ‡¬πŸ‡§), customs duties may apply and are the Customer's responsibility.

5. Payment

Payment is due at the time of order. Accepted methods: bank card, bank transfer, secure electronic wallet payment. Payments are secured through our approved provider.

6. Delivery

6.1 Delivery Areas

The Company delivers to the following countries: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom. Delivery is made to the address provided by the Customer at the time of order, either to their home or to a pickup point.

6.2 Timescales

Estimated delivery times are between 1 and 10 working days depending on the destination. In the event of delay or stock shortage, the Customer will be informed.

7. Right of Withdrawal

In accordance with the local legislation of the Customer's country, the Customer has 14 days from receipt to exercise their right of withdrawal, without having to give a reason.

⚠️ The right of withdrawal does not apply to opened, perishable or personalised products.

To exercise this right, the Customer must contact our customer service at [email protected]. Return shipping costs remain the Customer's responsibility.

8. Liability & Guarantees

8.1 Legal Guarantee

In accordance with European regulations, products sold benefit from the legal guarantee of conformity for a period of 2 years from delivery.

For perishable products or those with a use-by date, the guarantee applies only until that date, where it falls short of the legal guarantee period.

8.2 Limitation of Liability

The Company shall not be held liable for any indirect damage resulting from the use of the products sold.

9. Personal Data (GDPR)

Data collected is processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable local legislation in each Customer's country of residence, including the UK GDPR in the United Kingdom.

The Customer may at any time exercise their right of access, rectification, objection or deletion of their data via [email protected].

10. Mediation and Dispute Resolution

10.1 Customers residing in the EU (excluding UK)

In the event of a dispute, in accordance with European consumer legislation, the Customer may use a free consumer mediation service.

The name of the approved mediator and contact details will be provided on request by our customer service.

10.2 Customers residing in the United Kingdom

The Customer may file a complaint through an approved Alternative Dispute Resolution (ADR) body, or contact the UK International Consumer Centre.

11. Applicable Law and Jurisdiction

These T&Cs are governed by the law of the Customer's country of residence, pursuant to the Rome I Regulation. In the event of a dispute, the competent court is that of the consumer's place of residence.

12. Intellectual Property

All elements of the website (text, visuals, logos, trademarks) are the exclusive property of the Company. Any reproduction is prohibited without prior written authorisation.

13. Severability Clause

If any clause of these T&Cs is declared null or unenforceable, the remaining clauses shall retain their full validity.

14. Minimum Age

By accessing the website and making a purchase, the Customer declares that they are at least 18 years old (or the legal age in their country of residence if higher), and legally authorised to purchase hemp/CBD-based products.
